These Terms of Service (“Terms”) govern use of www.catchupweb.co.za and the consulting, support, and related professional services offered by CatchupWeb Consulting Services (“CatchupWeb”, “we”, “us”). By using this website, sending an enquiry, or engaging us, you agree to these Terms, our Privacy Policy, and our Refund and Cancellation Policy.
1. Who we are
CatchupWeb Consulting Services is a Johannesburg-based open-source IT consultancy. We advise on and deliver enterprise Linux, identity and directory services, automation, cloud and containers, observability, private AI infrastructure, and fractional senior engineering.
Email: info@catchupweb.co.za
Location: Johannesburg, South Africa
2. The website
The website is provided for information about our services. Content is general and is not a binding quote, legal opinion, or guarantee of a particular technical outcome. We may update pages, prices, or service descriptions at any time.
You may not scrape, copy, or reuse our site content, branding, or case descriptions for commercial purposes without written permission.
3. Enquiries and proposals
A contact form, email, or “book an assessment” request is not a contract. A paid engagement starts only when both parties accept a written proposal, statement of work, support schedule, or invoice terms (email confirmation is enough).
Information you send us about your environment is treated as confidential and used only to assess the work and deliver the service, as described in the Privacy Policy.
4. Services
Typical engagements include:
- technical assessments and architecture reviews;
- defined project or modernisation work with agreed milestones;
- managed or on-call open-source support;
- fractional principal / senior engineering time.
Scope, fees, timelines, and deliverables are those set out in the accepted proposal. Work outside that scope is quoted separately. We do not guarantee that third-party software, cloud providers, or your internal teams will behave in a particular way.
5. Client responsibilities
You must provide timely access, accurate information, a named decision-maker, and any licences or approvals needed for the work. Delays on your side may move dates and may be billed if we have reserved time.
You remain responsible for your production systems, change control, backups, and the business decision to implement a recommendation.
6. Fees and payment
Fees are in South African Rand unless we agree otherwise. Invoices are payable on the terms stated on the invoice (typically on presentation or within 14 days). Late amounts may pause work.
Prepaid hours, retainers, and assessment fees are described in the Refund and Cancellation Policy.
7. Intellectual property
Each party keeps the IP it already owns. On full payment, you receive a licence to use deliverables we create for you in your business. We may reuse generic methods, scripts, and know-how that are not your confidential information. CatchupWeb branding and this website remain ours.
8. Confidentiality and personal information
We keep client information confidential and process personal information under POPIA and the Privacy Policy. We will not use your environment details as a public case study without your consent.
9. Acceptable use of the website
Do not misuse the site: no probing, spam, malware, or automated harvesting. We may block access that we reasonably consider abusive.
10. Limitation of liability
Nothing in these Terms limits liability that South African law does not allow us to limit, including fraud or gross negligence, or rights a consumer has under the Consumer Protection Act 68 of 2008.
Subject to that, CatchupWeb is not liable for indirect or consequential loss, lost profits, lost data, or business interruption. Our total liability for an engagement is limited to the fees you actually paid us for that engagement in the previous 12 months.
11. Independent contractor
We act as an independent contractor, not as your employee, partner, or exclusive supplier, unless a written agreement says otherwise.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have jurisdiction, with Gauteng as the preferred forum. Please email info@catchupweb.co.za first so we can try to resolve a complaint.
These Terms, the Privacy Policy, the Refund and Cancellation Policy, and the accepted proposal are the agreement for the relevant work.
